Obama declares major disaster in Oklahoma after deadly tornadoes

WASHINGTON (Reuters) - President Barack Obama declared a major disaster in Oklahoma after deadly tornadoes struck the state on Sunday and Monday and ordered federal aid to supplement state and local recovery efforts, the White House said on Monday.

The White House said aid can include grants for temporary housing, home repairs, uninsured property losses and other recovery efforts.

Obama spoke by telephone with Oklahoma Governor Mary Fallin earlier on Monday, the White House said.

Wyo. student who threatened to rape self on Facebook was convicted of assault

The 28-year-old University of Wyoming student who allegedly threatened herself with rape in a Facebook hoax in April was convicted of aggravated assault in 2005 after she brandished a gun at an employer who fired her.

Meg Lanker-Simons, now a newly-minted UW graduate, was charged with interference with a police investigation after she allegedly posted on an anonymous Facebook forum that she wanted to engage in angry sexual intercourse ? with someone named ?Meg Lanker Simons.?

The posting on UW Crushes read:

?I want to hatefuck Meg Lanker Simons so hard. That chick runs her liberal mouth all the time and doesn?t care who knows it. I think its so hot and makes me angry. One night with me and shes gonna be a good Republican bitch.?

It turns out that the April 24 incident isn?t the strident leftist?s first rodeo in Wyoming?s criminal system. As the Laramie Boomerang reports, Lanker-Simons had an aggravated assault conviction in 2005 as the result of a bizarre gun-brandishing incident.

After Lanker-Simons was fired from a radio station in the fall of 2005, she returned and pulled a Glock 22 .40 caliber handgun from her purse. She waved the semi-automatic pistol around. She pointed it at the man who sacked her. He testified that he was ?in fear for his life,? notes the Boomerang.

The radio station was evacuated. Police caught Lanker-Simons as she tried to flee the scene in her vehicle. They held her at gunpoint.

In July 2006, Lanker-Simons ? then known as Meghan Michelena ? was sentenced to six years of probation. Her term of probation was subject to a number of conditions. She had to undergo counseling, complete community service, pay fines and apologize to her victims. She was also prevented from owning any guns.

The alleged Facebook hoax brought national attention to the Cowboy State?s flagship college. Initially, the administration stood firmly behind Lanker-Simons. ?No student should have to deal with such threatening language,? said one sternly-worded official statement. A school official also denounced ?rape culture,? according to KOWB.

Concerned fellow feminists also threw a rally for Lanker-Simons ? complete with all manner of signs condemning rape threats ? before police concluded that Lanker-Simons herself was behind the threats.

This month, Lanker-Simons participated in the University of Wyoming?s commencement ceremonies despite the charges against her. She graduated with a bachelor?s degree in psychology.

Lanker-Simons is also a blogger and a local radio host.

In 2010, Lanker-Simons and Bill Ayers sued the University of Wyoming after school officials decided to cancel a speech by Ayers, a former Weather Underground radical and mentor to President Obama. Also in 2010, her husband, Andrew Simons, ran a failed Democratic campaign for Wyoming secretary of state.

According to the Boomerang, the interference charge is a misdemeanor punishable by a prison sentence up to a year and a fine up to $1,000.

It?s probably just my age (the big 3-0) but everyone I know seems to be knocked up. Friends, family, co-workers? Apparently I roll with a? fertile crowd. With so many people pregnant, the cost of baby shower gifts was really adding up. A shower here, a shower there and I?m broke. Ok I?m exaggerating. But with all the baby showers, wedding showers and bachelorette parties I?ve been invited to (love you guys, don?t stop the invites) I?m feeling a little cash strapped.

Sure I budget for gifts, but nobody could anticipate so many gifts ?coming due? at the same time.Throw in the regular birthdays and holidays and my budget has taken a beating.

Instead of skimping on gifts or sending impersonal gift cards or cash, I?ve decided to get a little strategic about my gift gifting. Thanks to coupons and a crafty ex-roommate who taught me to knit, I?m revolutionizing the way I think about baby gifts. Here?s how:

  • Make My Own. 1 Skein of yarn ($4.00 or less when I use a 50% off coupon at AC Moore or Michaels) and about 6 hours yields an adorable little baby sweater. I have several big boxes of yarn that I bought when I was obsessed with knitting in college, so I?m still working through that yarn. I typically knit on the bus and while watching TV at night. When you figure in the time?could I buy something cheaper, yes. But it wouldn?t be a handmade original made with love by me. I also make baby clothes and booties, and sew burp cloths and baby quilts-see below (when I have time).

  • Buy On Sale. Whenever I see baby stuff (or any type of toys or games) on deep clearance I buy them. I stock up on baby items and stick them in my closet for upcoming showers. I recently picked up a bunch of cute Easter onesies for $1.00 a piece (none of them said Easter, they were just pastel colors) to keep for future gifts.
  • Use Coupons. Sales combined with coupons are my favorite way to get free and really cheap baby stuff. Johnson and Johnson baby products often go on sale and combined with a coupon you can get them for free. I recently found a sale on baby lotion, body wash, and powder. All of the items were $2.00 a piece. Combined with a $0.75 coupon that doubled at the grocery store I got them for $0.50 a piece. They typically retail for $4-6.00 each!

  • Give Coupons. Sounds a little strange, but diapers, formula and food can get really expensive. A few years back a friend of mine was feeding a pretty expensive formula. She was always asking me for the formula coupons from my paper. She had her shower after the baby was born, so to surprise her, I gathered a bunch of papers from my friends and clipped a whole stack of the $5.00 coupons for the formula she used. She told me it was the best ?gift? anyone gave her.

Once I buy and make all the gifts, I put it them in a basket and tie it up with a big ribbon. Easy Peasy and really fun. I?ve received really good feedback from friends and family who have loved their baby gifts.

When green means danger: A stunning new species of palm-pitviper from Honduras

A new species of green palm-pitviper of the genus Bothriechis is described from a seriously threatened cloud forest reserve in northern Honduras. Because of similarity in color pattern and scalation, the new species (Bothriechis guifarroi) was previously confused with other Honduran palm pitvipers. Genetic analysis revealed that the closest relatives of the new species are actually found over 600 km to the south, in the mountains of Costa Rica. The study was published in the open access journal Zookeys.

The gorgeous new species was discovered by scientists during two expeditions in 2010 aimed at studying the fauna of Texiguat Wildlife Refuge, one of the most endemism-rich and diverse highland forests in Mesoamerica. This beautiful, but highly toxic, snake represents the 15th endemic species occurring in the region. Texiguat Wildlife Refuge was created in 1987 to protect populations of wildlife such as the famous but elusive jaguar and Central America tapir, as well as howler and white-faced monkeys, sloths, and a variety of endemic amphibians, reptiles, and plants.

To draw attention to the dedication and sacrifice of many grassroots conservationists in Honduras and Central America, the new species was named in honor of Mario Guifarro of Olancho. Guifarro was a former hunter and gold miner who became an outspoken conservationist when he saw the vast rainforests of eastern Honduras being destroyed and converted to cattle ranches. After years of threats and multiple attempts on his life, Guifarro was ambushed and murdered on 15 September 2007 while on a mission to delimit a biosphere reserve for the indigenous Tawahka.

The lead author of the study Dr Josiah Townsend, Department of Biology, Indiana University of Pennsylvania, comments on the importance of the discovery and conservation status of the new species: "The description of Bothriechis guifarroi has important implications for Central American biogeography as well as conservation. We recommend that B. guifarroi be immediately classified as Critically Endangered due to its limited known area of occurrence and the potential for anthropogenic damage to its habitat. We also consider that this species warrants immediate consideration for protection under CITES, given its striking appearance and high potential for exploitation in the pet trade."

A lucky winner could take home one of Powerball's largest jackpots on Wednesday night as the prize rose to an estimated $360 million dollars.

That makes it the third largest Powerball jackpot in at least a decade. Lottery officials have said that such stratospheric payouts will become more common as a result of a redesign last year. Those changes were intended to produce bigger jackpots faster, and raised the price of a ticket to $2.

?It usually took a handful of months, if not several months, for a jackpot to reach this large amount,? Iowa Lottery spokeswoman Mary Neubauer told the Associated Press. ?Now it?s achieving that within a handful of weeks. I think the redesign is achieving exactly what we had wanted it to achieve, which is the bigger, faster-growing jackpot.?

Powerball tickets are sold in 43 states. The biggest Powerball jackpot ever totaled $587.5 million and was split between two tickets on Nov. 28. New Jersey resident Pedro Quezada won the fourth largest Powerball prize ever in March, taking home a $338 million jackpot.

While odds of getting rich quick remain slim, more players are likely to take home a smaller prize by matching fewer numbers. And for those who miss tonight's jackpot can take consolation: the Mega Millions jackpot rolled over to $190 million Tuesday night. The next drawing of that game comes Friday.

Obama says U.S. diplomatic, military options remain open in Syria crisis

WASHINGTON (Reuters) - President Barack Obama said on Thursday he reserves the right to resort to a range of diplomatic and military options if he gets conclusive proof that the government of Syrian President Bashar al-Assad had used chemical weapons in the country's civil war.

Obama, at a joint news conference with Turkish Prime Minister Tayyip Erdogan, said there was evidence of chemical weapons use in Syria but that it is important to get "more specific information" to confirm this before deciding how to respond.

Erdogan had been expected to push Obama, at least in private, for more assertive action on Syria during a visit to Washington this week, days after car bombs tore through a Turkish border town in the deadliest spillover of violence yet.

But the two leaders showed no sign of friction in their appearance in the White House Rose Garden and sought to project a united front on Syria.

Obama - who has been reluctant to arm Syrian rebels or become enmeshed militarily in the two-year-old conflict - expressed hope that the United States and Russia would succeed in arranging a peace conference that would produce results.

But Obama, who had insisted chemical weapons use would be a "game changer," made clear, however, that Washington was keeping all options on the table, though he did not provide specifics.

"There are a whole range of options that the United States is already engaged in," he told reporters. "And I preserve the options of taking additional steps, both diplomatic and military, because those chemical weapons inside of Syria also threaten our security over the long term as well as our allies and friends and neighbors."

Erdogan said Turkey was in "full consensus" with the United States on the need to end the bloodshed in Syria and for a political transition to a government without Assad.

The planet-hunting Kepler spacecraft?s dramatic, some would say romantic, quest for an Earth-like exoplanet orbiting a star in its habitable zone has suddenly been put on hold, NASA officials said Tuesday, while engineers try to figure out what caused the craft to lose its ability to point itself at its distant targets.

The spacecraft is essentially hibernating, NASA said at a hastily called briefing late Wednesday afternoon, having put itself into "safe mode" on Sunday after sensing it was pointing in the wrong direction.

Controllers discovered the glitch Tuesday during their twice-a-week touch-base with the craft, currently some 40 million miles away in an Earth-like orbit around the sun.

When the craft is in safe mode, thrusters control its orientation, rather than the fast-spinning ?reaction wheels? that normally provide stability. The craft uses these wheels to maintain the exquisite pointing precision needed to relentlessly stare at stars long enough to detect the telltale dimming imposed by a planet as its orbit carries it in front of the star.

As controllers tried to restart the craft's reaction wheels Tuesday, one of the wheels woke up, then balked. This left the craft with two functioning wheels. It needs three to resume observing the patch of sky that for four years it has scanned for Earth-like planets in Earth-like orbits around sun-like stars.

While the malfunction is serious, NASA officials were not ready Wednesday to declare the mission over.

"The loss of the reaction wheel is not good news," said Charles Sobeck, Kepler's deputy project manager at NASA's Ames Research Center in Mountain View, Calif.

The goal now is to place the craft in an operating mode that reduces the use of its thrusters in order to preserve fuel and "take the time to figure out what to do next," he said.

Kepler was launched in March 2009 as a kind of planetary census taker. The mission's aim is to observe the same 170,000 stars in a hunt for rocky planets orbiting in their stars' habitable zones ? roughly defined as a distance that leaves a planet's surface not too hot or not too cold, but just right for liquid water to persist on its surface. Liquid water is a key prerequisite for organic life.

To date, Kepler has found Earth-mass planets. And it has found larger, super-Earths orbiting in their star's habitable zones. The Kepler team has yet to uncover its ultimate planets. But after bagging more than 2,700 planet-candidates so far, finding the first "just right" extra-solar planet isn't far off, says William Borucki, the mission's lead scientist.

"I'm absolutely delighted that we've got all this data," he said at the briefing. "The mission was designed for four years. It operated four years. It gave us excellent data for four years. On the other hand, I would have been even happier if it continues another four years."

U.S. car use falls as younger generation shifts gears: study

NEW YORK (Reuters) - Americans are driving less than they used to because of higher gasoline prices, a weak economy and changing generational preferences, according to a report released Tuesday that found a sixty-year "driving boom" had hit the brakes.

The report, by advocacy organizations the U.S. Public Interest Research Group and Frontier Group, said transportation policymakers and existing plans to expand the nation's roads and highways have not taken the decline into account.

The researchers said car use is likely to decline further as members of the Millennial generation, now in their teens to early 30s, move into cities and rely more on public transportation, while car-loving baby boomers age out of their "peak driving" years.

People aged 16 to 34 racked up 23 percent less mileage in 2009 than in 2001, the study said, demonstrating a greater decline in driving than for any other age group.

"This is a new direction - a real break, a real change, the study's co-author, Phineas Baxandall, an analyst at the U.S. PIRG, said in a briefing on Tuesday. "After 2004, on per capita basis, driving has gone down, and the number of vehicle-miles driven has also gone down each year since 2004."

This trend is reflected in vehicle ownership, which has decreased by 4 percent between the all-time high of 1.24 vehicles per driver in 2006 and now.

The percentage of driving-age Americans with licenses also fell to a 30-year low of 86 percent in 2011 from an all-time high of 90 percent in 1992.

Meanwhile, the average inflation-adjusted price of gasoline doubled between 2002 and 2011. In the short term, the study said, higher fuel prices may lead people to skip long road trips or vacations; in the longer run, sticker shock at the gas station could encourage people to lower or avoid the expense of driving by living closer to work or buying more efficient cars.

The researchers said federal and certain state governments have nevertheless continued to allocate funds to large highway expansion projects based on "obsolete" forecasts "based on assumptions forged during the driving boom," said co-author Tony Dutzik, a policy analyst at the Frontier Group.

"We invest tens of billions of dollars in our transportation systems so it's important that we're doing so with a clear understanding of what we know and don't know about the future," Dutzik said.

The study noted that "the number of miles driven in the heaviest trucks has actually declined faster than overall vehicle travel in recent years, falling by 11 percent between 2007 and 2011." It said there was "little evidence thus far for the proposition that reductions in household driving must coincide with an increase in heavy-duty truck traffic."

Sean McAlinden, chief economist and vice president for research at the Michigan-based non-profit Center for Automotive Research, dismissed the report's findings.

"Younger buyers under 30 are listing financial problems as their reason for not buying new cars," McAlinden said. "If and when the economy recovers, will buy cars at the same rate as other generations."

The reported declines in driving coincide with weakness in the U.S. economy, which emerged from a brutal recession in June 2009 and was still in tepid recovery in 2011. However, driving did not pick up in line with the recovery, Dutzik said.

"That suggests that the recovery of the economy might not necessarily lead to the kinds of increases in driving that we saw in past decades."

The study noted that cycling, walking, light rail and other alternative methods of transportation have gained popularity in recent years: In 2011, Americans took nearly 10 percent more trips via public transportation than they had in 2005.

Young Americans in their late teens and 20's are less enthralled with the automobile than prior generations and are seen as regarding high-tech devices, including tablet computers and smartphones, as more important status symbols than cars.

That has led major automakers, including General Motors Co. , Ford Motor Co. and Toyota Motor Corp. to rework their lineups with different body styles and more tech-savvy features aimed drawing young Americans' interest.

Wall Street ends near flat after recent gains; healthcare climbs

NEW YORK (Reuters) - U.S. stocks ended flat on Monday, pausing after hitting record highs last week, but strength in healthcare issues helped to keep declines in check.

The S&P 500 healthcare sector climbed 0.7 percent and was the day's best performer.

Shares of Theravance jumped 17.9 percent to $41.20 after Irish drugmaker Elan agreed to a $1 billion deal to buy 21 percent of the royalties that Theravance receives from GlaxoSmithKline for its respiratory drugs.

The day's flat activity follows a third straight week of gains on the major indexes, with both the Dow and S&P 500 setting record closing highs last week. The S&P 500 remains up 14.5 percent for the year so far.

While some analysts argue the long-term trend is still higher, many see momentum waning in the near term in the absence of positive catalysts. Volume has been lighter than average, and volatility has been low in recent days.

"Intraday volatility has essentially been nonexistent. I think it means people are really sitting on the sidelines right now seeing which way it's going to go," said Uri Landesman, president of Platinum Partners in New York.

The CBOE Volatility index ended down 0.3 percent.

The Dow Jones industrial average was down 26.81 points, or 0.18 percent, at 15,091.68. The Standard & Poor's 500 Index was up 0.07 points at 1,633.77. The Nasdaq Composite Index was up 2.21 points, or 0.06 percent, at 3,438.79.

Among the day's decliners, Yum Brands Inc fell 2 percent to $68.92. After the market closed on Friday, the fast food chain operator posted a steep decline in Chinese April sales.

Helping to limit the market's downside, retail sales rose 0.1 percent in April, better than the 0.3 percent drop that had been expected, and returning to growth following a decline in March. Excluding autos, gasoline and building materials, core sales rose 0.5 percent. Retail sales account for about 30 percent of U.S. consumer spending.

Investors are at odds over whether positive economic data can help the market rise further, or whether it will spell the end of the Federal Reserve's monetary stimulus, which could derail the rally, said Joseph Tanious, global market strategist at J.P. Morgan Funds.

Other data showed business inventories were unchanged in March for a second straight month, versus expectations of 0.3 percent rise, suggesting restocking could help second-quarter economic growth.

Earnings have been mostly better than expected. With 90 percent of the S&P 500 having reported, 67.2 percent of companies have topped earnings expectations, according to Thomson Reuters data, even with the average over the past four quarters. Only 46.9 percent have beaten revenue expectations, below the 52 percent average over the past four quarters.

U.S.-listed shares of Perion Network surged 10.6 percent to $13.94 after the Israeli consumer Internet company posted first-quarter earnings.

Drug manufacturer agrees to $500 million penalty in FDA deal

WASHINGTON (AP) ? A subsidiary of India's largest pharmaceutical company has agreed to pay $500 million in fines and civil penalties for selling adulterated drugs and lying about tests of the medications to federal regulators, the U.S. Justice Department said Monday.

Prosecutors said the guilty plea by Ranbaxy USA Inc. represents the largest financial penalty by a generic drug company for violations of the Federal Food, Drug and Cosmetic Act, which prohibits the sale of impure drugs.

The subsidiary of Ranbaxy Laboratories Limited admitted that it made and sold impure drugs at two manufacturing sites in India. The batches of adulterated drugs, whose strength, purity or quality differed from the specifications, included generic versions of an antibiotic and other medications used to treat severe acne, epilepsy and nerve pain, prosecutors said.

The company said it fully cooperated with the investigation, which it said involved actions from several years ago, and expects "future growth in the U.S. and around the world."

"While we are disappointed by the conduct of the past that led to this investigation, we strongly believe that settling this matter now is in the best interest of all of Ranbaxy's stakeholders; the conclusion of the DOJ investigation does not materially impact our current financial situation or performance," Ranbaxy CEO Arun Sawhney said in a statement.

The company agreed to a fine and forfeiture of $150 million as well as an additional $350 million penalty to settle civil claims that it submitted false statements to Medicaid, Medicare and other government health care programs. About $49 million of that penalty will go to a former Ranbaxy executive who acted as a whistleblower, prosecutors said.

The company also admitted making false statements to the Food and Drug Administration about dates of stability testing, which detect impurities of a drug and determines appropriate storage conditions of it. In some cases, the tests were done months after the company had said they'd been performed, or were done on the same day ? or within days of each other ? instead of months apart.

TV psychologist Joyce Brothers dies at age 85: publicist

(Reuters) - U.S. psychologist Joyce Brothers, who parlayed winning the "The $64,000 Question" TV game show in 1955 into a nearly six-decade career as a television personality and columnist, died on Monday, her publicist said. She was 85.

Brothers died of natural causes in New York, said Sanford Brokaw, her Los Angeles-based spokesman.

She began dispensing advice on television in 1958 and penned columns on topics such as sex and relationships until early 2013.

She also had a prodigious knowledge of boxing and is thought to be the sport's first female commentator.

Brothers was born on October 20, 1927 in New York City and married physician Milton Brothers in 1949.

She is survived by her sister, daughter, four grandchildren and two great-grandchildren.

(AP) ? LeBron James scored 27 points and the Miami Heat nearly matched a franchise record for points allowed in a playoff game, pounding the listless and short-handed Chicago Bulls 88-65 on Monday night to take a 3-1 lead in the Eastern Conference semifinals.

The 65 points allowed were only two more than the all-time postseason low for a Miami opponent, and it was easily the worst offensive performance by a Chicago team.

Never before had the Bulls scored fewer than 69 in a playoff game nor 10 or less in a quarter during the postseason, but both those marks fell on a night when they were dominated on both ends of the floor.

Miami led by 11 at the half and put this one away in the third quarter, outscoring Chicago 17-9 in the period.

Now the Heat will try to wrap up the series at home on Wednesday night, taking what they hope will be the next step toward a second straight championship.

It's hard to believe the Bulls won the series opener the way the past three games have gone.

Miami pounded Chicago in Game 2, coming away with its most lopsided playoff victory while handing the Bulls their worst ever postseason loss, and the Heat continued to roll from there.

James had his usual complete game with eight assists and seven rebounds Monday.

Chris Bosh finished with 14 points after scoring 20 and grabbing 19 rebounds in Game 3, and the Heat won again despite another quiet night from Dwyane Wade, who finished with six points. Norris Cole also struggled with seven points after back-to-back 18-point performances, but the Heat had more than enough in this one.

They shot about 49 percent while the Bulls set a franchise playoff low at 25.7 percent. They were particularly bad from the outside, going 2 for 17 from 3-point range.

The Bulls again were missing ailing Luol Deng and injured Kirk Hinrich (calf), and a team that kept finding ways to win despite being short-handed all season simply appeared to run out of steam.

Carlos Boozer had 14 points and 12 rebounds for his fifth double-double in the postseason but was just 3 of 14 from the field. Jimmy Butler scored 12 and Joakim Noah grabbed nine rebounds, but it was a miserable night for Chicago ? particularly Nate Robinson, who missed all 12 shots and did not score.

James scored 15 points and Bosh added 12 in the first half to help the Heat take a 44-33 lead at the break, but that doesn't even come close to telling the complete story.

Consider this.

Miami shot just under 53 percent, with the Bulls at about 27 percent. Chicago was also 1 of 11 on 3-pointers, and the only conversion from long range came from Richard Hamilton.

After playing a grand total of 10 minutes over two playoff appearances, coach Tom Thibodeau turned to him early in the second quarter with Miami threatening to put the game away.

The veteran guard entered to loud cheers with the Bulls trailing 30-17 after back-to-back 3-pointers by Shane Battier and Ray Allen, and the crowd was roaring after Hamilton nailed a wide open 3 from up top and Taj Gibson converted a three-point play.

That made it a seven-point game, but the Bulls couldn't sustain any momentum. The Heat suffocated them on both ends, squeezing a little harder every time Chicago made a push.

There was no energy from the Bulls, none of the resourcefulness that carried them to 45 wins during the regular season and to the second round in the playoffs.

They were trailing 44-31 with about 40 seconds left after James made a neat spin move on the break and got fouled by Nate Robinson for a three-point play.

Notes: The Heat and Bulls were well represented on the NBA's all-defensive first team, with James and Noah being selected. ... Thibodeau had nothing to say about the $35,000 fine from the league for comments he made about the officiating in Game 3. Asked if he was surprised by the amount, he said, "I've got no comment on that. We're just getting ready for Game 4." ... Deng was listed as active after initially being ruled out for Chicago. Hinrich and Rose were inactive.

Ginsburg says Roe gave abortion opponents target

CHICAGO (AP) ? One of the most liberal members of the U.S. Supreme Court, Justice Ruth Bader Ginsburg could be expected to give a rousing defense of Roe v. Wade in reflecting on the landmark vote 40 years after it established a nationwide right to abortion.

Instead, Ginsburg told an audience Saturday at the University of Chicago Law School that while she supports a woman's right to choose, she feels the ruling by her predecessors on the court was too sweeping and gave abortion opponents a symbol to target. Ever since, she said, the momentum has been on the other side, with anger over Roe fueling a state-by-state campaign that has placed more restrictions on abortion.

"That was my concern, that the court had given opponents of access to abortion a target to aim at relentlessly," she told a crowd of students. "... My criticism of Roe is that it seemed to have stopped the momentum that was on the side of change."

The ruling is also a disappointment to a degree, Ginsburg said, because it was not argued in weighty terms of advancing women's rights. Rather, the Roe opinion, written by Justice Harry Blackmun, centered on the right to privacy and asserted that it extended to a woman's decision on whether to end a pregnancy.

Four decades later, abortion is one of the most polarizing issues in American life, and anti-abortion activists have pushed legislation at the state level in an effort to scale back the 1973 decision.

Ginsburg would have rather seen the justices make a narrower decision that struck down only the Texas law that brought the matter before the court. That law allowed abortions only to save a mother's life.

A more restrained judgment would have sent a message while allowing momentum to build at a time when a number of states were expanding abortion rights, she said. She added that it might also have denied opponents the argument that abortion rights resulted from an undemocratic process in the decision by "unelected old men."

Ginsburg told the students she prefers what she termed "judicial restraint" and argued that such an approach can be more effective than expansive, aggressive decisions.

"The court can put its stamp of approval on the side of change and let that change develop in the political process," she said.

A similar dynamic is playing out over gay marriage and the speculation over how the Supreme Court might act on that issue.

The court decided in December to take up cases on California's constitutional ban on gay marriage and a federal law that denies to gay Americans who are legally married the favorable tax treatment and a range of health and pension benefits otherwise available to married couples.

Among the questions now is whether the justices will set a nationwide rule that could lead to the overturning of laws in more than three dozen states that currently do not allow same-sex marriage. Even some supporters of gay marriage fear that a broad ruling could put the court ahead of the nation on a hot-button social issue and provoke a backlash similar to the one that has fueled the anti-abortion movement in the years following Roe.

The court could also decide to uphold California's ban ? an outcome that would not affect the District of Columbia and the 11 states that allow gay marriage.

Ginsburg did not address the pending gay marriage cases.

Asked about the continuing challenges to abortion rights, Ginsburg said that in her view Roe's legacy will ultimately hold up.

"It's not going to matter that much," she said. "Take the worst-case scenario ... suppose the decision were overruled; you would have a number of states that will never go back to the way it was."

"That's how we play Pacers basketball," George said. "We just locked in, and it was just helping one another on the defensive end."

Sure, Indiana could have been sidetracked by the embarrassing 26-point loss at New York in Game 2. Or it could have gotten caught up in the pregame banter about Amare Stoudemire's impending return or J.R Smith's sudden illness.

But the Pacers never got distracted.

Coach Frank Vogel's bunch followed the same game plan it has all season -- locking down defensively, winning the rebounding battle and protecting its home court.

Check, check and check.

Indiana limited the Knicks to 35.2 percent shooting from the floor, allowed just three 3-pointers and forced 15 turnovers. And, of course, the league's No. 1 rebounding team dominated the glass again, finishing with a 53-40 rebounding edge and a 20-10 edge in second-chance points.

It was enough to allow the Pacers to overcome a 28 for 80 shooting performance that included a season-high 33 3-point attempts.

"They outrebounded us, they won the hustle today, the little things," Carmelo Anthony said. "It all came down to us not scoring the basketball. ... We can't beat anyone scoring 71 points."

It's the same formula Indiana won Game 1, and now, if Indiana wins a fifth straight home playoff game Tuesday night, it will head back to Madison Square Garden with a commanding lead over a longtime rival.

How did the Pacers do it again? They relied on scoring balance and in-your-face defense.

HIbbert kept loose balls alive in his best playoff performance of this postseason. Vogel called it his best playoff game ever.

George struggled to score, finishing with 14 points, but he also finished had eight rebounds and eight assists and caused plenty of consternation for Anthony and others on defense.

David West got off to a slow start but finished with 11 points and 12 rebounds and George Hill knocked down five 3s and he finished with 17 points.

"We didn't change much in terms of our physicality," West said. "I just thought we were a little bit more precise defensively in terms of our communication and we shored some things up. We didn't allow them to get some of the things they got in the second game in New York."

The Knicks had only one player in double figures. Carmelo Anthony scored 21, but the NBA scoring champion went j6 of 16 from the field, managed only two points and no baskets in the fourth quarter and finished well below his playoff scoring average of 29.3.

He was hardly alone.

Smith gave it a go although his shooting woes continued. He went 4 of 12, scored nine points and walked directly to locker room when he was replaced midway through the fourth quarter. A few minutes later, he came back into the game and is now just 11 of 42 from the field in the series.

Stoudemire looked rusty in his return, making just 3 of 8 eight shots -- one a dunk, another on a buzzer-beating 3-pointer to end the third quarter -- and finished with seven points and two rebounds.

The Knicks led once in the game, for just 76 seconds, and barely escaped the ignominy of setting a franchise playoff record for fewest points in a game. The all-time low is 67. New York didn't hit 68 until Kenyon Martin's dunk with 1:39 to play.

"Offensively, we just didn't have anything," coach Mike Woodson said. "I thought defensively, we hung in there and did what we had had to do, but we just didn't have any offensive pop and we have to figure that out."

And fast or the second-seeded Knicks will spend the rest of this series playing catch-up.

New York had a chance midway through the third quarter when it closed the deficit to 44-41. But instead of faltering, as the Pacers did in Game 2, they thrived on New York's miscues.

When Tyson Chandler was called for his third foul, he lost his cool and was whistled for a technical foul. That allowed the Pacers to score three points on the possession. West followed that with a 19-foot jumper and after Chandler went 1-of-2 from the free throw line, Indiana seized control with a 9-0 run that made it 58-44.

Stoudemire's buzzer-beater to end the quarter got the Knicks within 62-51 and New York eventually got as close as 65-57 with 9:10 left. But Indiana answered with seven straight points and never let the Knicks challenge again.

"Our guys usually do what you emphasize," Vogel said. "We don't want to do it at the expense of giving up things up at the rim. But we were able to guard the paint and the 3-point line, and that's the goal."

Notes: The Pacers are 4-0 at home with an average victory margin of 16.5 points. ... New York is now 0-3 at Bankers Life Fieldhouse this season. ...
